Terms of Service

These terms form the agreement between you and Nikolas Michael Academy when you use our app, website or course content. By creating an account you accept them.

Who we are

Nikolas Michael Academy — a sole proprietorship operated by Nikolas Michael
5 Ypsilanti Avenue, Glen Ashley, Durban, 4051, South Africa
nik@nikolasmichael.co.za

Your account

  • You must be 18 or older.
  • Give accurate details, and keep your password to yourself.
  • Your account is for you alone. Sharing your login, or your access, is a breach of these terms and we may suspend the account without refund.
  • Tell us promptly if you think someone else has got into your account.

Membership and payment

  • Membership costs R600 per month, in South African Rand, including VAT where applicable.
  • You can pay by card on our website. Those payments are processed by Paystack, and we never see or hold your card details.
  • Where membership is bought inside the app through Google Play or the Apple App Store, payment, renewal and cancellation are handled by that store under its own terms, and refund requests go to the store rather than to us.
  • Some members are given an access code instead of a subscription — see Access codes below.
  • Your membership renews automatically each month until you cancel it.
  • You may cancel at any time. Cancelling stops the next payment.
  • We do not refund the current month. You keep full access until the end of the period you have already paid for.
  • If a payment fails we may retry it, and access may pause until it succeeds.
  • We may change the price, with at least 30 days’ notice. You may cancel before it takes effect.

To cancel: email nik@nikolasmichael.co.za or message us on WhatsApp from the app, and we will confirm in writing. If you subscribed through Google Play or the App Store, cancel in that store’s subscription settings instead.

Access codes

  • Promotional access codes are personal, single-use, and not transferable.
  • A code gives full access for a fixed period, after which access ends automatically.
  • Codes have no cash value and cannot be exchanged or refunded.
  • We may cancel a code that has been shared, resold or misused.

The course content

  • Your membership gives you a personal, non-transferable right to watch the lessons and read the theory documents for your own learning.
  • All course videos and documents, and the Nikolas Michael name and branding, remain our property.
  • You may not record, download, copy, re-upload, share or resell any part of the course, or show it to a group as training, without our written permission.
  • We may add, change or retire content as the course develops.

Your portfolio submissions

  • You keep ownership of the photographs you upload.
  • You give us permission to store and view them in order to assess your work and give feedback.
  • We will not use your photographs publicly or in marketing without asking you first and getting your agreement in writing.
  • If a photograph shows a client or model, you confirm you have their permission to upload it.
  • We may remove a submission that is offensive, unlawful, or not your own work.

Assessment and the certificate

  • Nikolas Michael personally reviews each submission and decides whether the work demonstrates competence.
  • A certificate is awarded at his discretion. Paying for membership, or submitting work, does not entitle you to one.
  • You may be asked to resubmit work before a certificate is awarded.

What the certificate is. The Nikolas Michael Academy Certificate of Completion records that Nikolas Michael has assessed your practical work and considers you competent in the four core cutting structures. It is not a nationally accredited qualification, it is not registered with a SETA, the QCTO or SAQA, and it does not by itself entitle you to registration, employment or a licence. It is a record of training completed with this Academy.

What we do not promise

  • The course is educational. We cannot promise it will lead to work, income, or any particular outcome.
  • Cutting hair carries risk. You are responsible for your own practice, your tools, your hygiene, and the safety of anyone whose hair you cut.
  • We aim to keep the app available but cannot guarantee uninterrupted service.
  • To the extent the law allows, our liability to you is limited to the amount you have paid us in the three months before the claim.
  • Nothing here limits any right you have under the Consumer Protection Act, 2008 that cannot lawfully be excluded.

Ending the agreement

You may close your account at any time — see Delete your account. We may suspend or close an account that breaches these terms — in particular for sharing a login or redistributing course content — without refund. On closure your access ends; your information is handled as set out in our Privacy Policy.

Changes

We may update these terms. We will update the date above and, for significant changes, tell you in the app or by email. Continuing to use the Academy after a change means you accept it.

Governing law

These terms are governed by the law of the Republic of South Africa, and the South African courts have jurisdiction.
